PartyKarma Affiliate Agreement

 

PartyKarma Affiliate Agreement ("Agreement") sets out the terms and conditions under which PartyKarma.com ("PartyKarma") makes PartyKarma Affiliate Program ("Affiliate Program") available to you. To become a PartyKarma Affiliate you agree to be legally bound by the terms of this Agreement. You agree to be bound by the terms of this Agreement as long as you continue using Affiliate Program.

PartyKarma Affiliate Terms of Service and PartyKarma Affiliate Privacy Policy are incorporated into this Agreement. As an affiliate you are also legally bound by terms of PartyKarma Affiliate Terms of Service and PartyKarma Affiliate Privacy Policy.

PartyKarma reserves the right to modify this Agreement and Policies from time to time such modifications being effective upon posting on PartyKarma Affiliate Site.

These Terms were last modified on September 28, 2006.

1. General Guidelines

a.     Eligibility. You must be 18 years of age to participate in PartyKarma affiliate program. "You" or "you" refers the party listed on the account you create with PartyKarma Affiliate Program and you represent you have the authority to agree to this Agreement for that party. You represent and warrant that you are authorized to act on behalf of, and bind to this Agreement, any third party for which you enter this Affiliate Program.

b.     Account. You must enroll in the Affiliate Program by completing a registration process and creating an Affiliate account ("Account") with us.

c.     Contact Info. You must provide PartyKarma Affiliate Program with accurate and complete contact and payment information when opening an Account. You agree to notify PartyKarma of any changes to your contact and/or payment information as soon as they occur. Incomplete or invalid information makes you ineligible to receive commissions from PartyKarma Affiliate Program.

d.     Tax Info.  You must provide us with your taxpayer information as required by IRS in order to receive commissions.  Tax ID is required for all affiliate companies, social security number is required for individual affiliates.  If we do not have your current tax information on file for the year commissions due to you will not be paid until December 31 of that year.  These commissions will also be subject to a 30% backup withholding which will be submitted to the IRS.

2. Links

As a member of the Affiliate Program you will be provided with special link formats ("Special Links") that are to be used to link back to PartyKarma.com Web Site. These links will enable tracking, reporting, and commission calculations. You must use these links in the format they are provided by the Affiliate Program in order to earn commissions. No commission will be paid for activities occurring at PartyKarma website which were not originated from properly formatted Special Links.

3. Commissions

PartyKarma Affiliate Programs pays commissions by the following structure:

  1. Per lead commission. Partykarma will pay $1 for each referred by you user who signs up with our site with valid email address, completes basic information in their profile and stays within the system for 3 months. At the end of 3 months period $1 will be credited to your account. Referral period (cookie) is valid up to 180 days, meaning that after coming to PartyKarma from your site visitors have up to 180 days to sign up with us and be considered your referral.

 

  1. Per sale commission. For each subscription to a paid service your account will be credited 50% of amount paid by the member for the first 6 months of their subscription period. We will pay commission on the paid subscription by members referred from your site without limitations to referral period, i.e. we will issue commission on the sale referred from your site even after expiration of 180 days from their first visit of PartyKarma from your site. In order to effectively manage drop outs and chargebacks commission will be credited to your account at the end of subscription period. Example, if a member subscribes to a month to month service at $9.95 a month, you will be credited $4.98 for six months after the end of each paid month. In case the subscription gets terminated within first 6 months you will be credited only for the months the subscription was active and paid for. If a member subscribes for more then one month at a time (6 months or 12 months) 50% of the amount paid will be credited to you after the end of subscription period - after 6 and 12 months respectively.

 

  1. Lead performance incentive. For each 1000 members referred to our site within 12 months period PartyKarma will credit you with $50.00. All of these members need to stay within our system for at least 3 months to qualify your referral for this incentive.

 

  1. Commission performance incentive. For each 100 paid subscriptions with the duration of at least 3 months referred by you to PartyKarma within 12 months period we will credit your account with $100.

 

Partykarma will only pay commissions on the leads and subscriptions generated from the United States.

 

4. Payment Terms

 

  1. Payout Schedule. PartyKarma Affiliate Programs pays commissions on a monthly basis. Payouts are issued on the 10th of each month for the commissions accrued within prior month. Minimum payout amount is $25.00. If the Commissions payable to you for any month are less than $25.00, they will be held in your Account until the total amount due is at least $25.00 or until this Agreement is terminated.

 

  1. Method of Payment. Preferred method of payment is PayPal. You must provide us with the email address to which the payments will be sent via PayPal.

 

  1. Processing Fees. If accrued Commissions amount in your account is less than $25.00 for at least 365 days, then we may send you payment of such accrued Commissions per your request minus a $5 processing fee. If the amount of accrued Commissions is under $5, such amount will be used to cover PartyKarma's administrative costs and no payment will be made to you. If no such request has been received from you then the money will stay in your Account after 365 days until the total amount due is at least $25.00.

5. Term and Termination

The term of this Agreement begins upon our acceptance of your Affiliate Program application and will end when terminated by either party.

In its sole discretion, with or without notice to you, we may terminate your participation in the Affiliate Program and terminate your Account. If PartyKarma.com determines, in its sole discretion, that you are abusing the system, PartyKarma.com may (without limiting any other rights or remedies available to it) withdraw your participation and withhold any Commissions payable to you.

You may terminate your Account for any reason at any time by contacting us by email at custsvc@partykarma.com.

You can only earn Commissions during the term of the Agreement, and Commissions earned through the date of termination will remain payable only if the related memberships and subscriptions are not canceled. PartyKarma.com will withhold your final payment for a reasonable time to ensure that the correct amount is paid.
